Why should an attorney supervise the execution of my will?
Return to FAQ VideosTranscript:
You should have an attorney prepare your will and supervise its execution, because the requirements are very technical. Also, upon the completion of the signing of the will in our office we prepare an affidavit of the witnesses containing all the necessary information and that of course is kept with the will and at the time the will is offered for probate we do not have to search for the witnesses, a witness may die so its important that a complete affidavit be prepared with the signing of the will.
Finally if there may be a contest concerning the will, when an attorney supervises the execution of the will, there is a very strong presumption in the law that the will was properly signed and executed before the witnesses and that can be of great value to you.
