What is a Separation Agreement?

If someone comes to our office and they’re looking to file for a divorce, we’ll discuss different options. One option may be if whether or not the party wants to see if a separation agreement can be negotiated with their spouse. Purpose of a separation agreement is to enter into a contract which decides all of the issues between the couple, except the issue of divorce itself. What I mean by that is that it’s only the court that can dissolve the marriage. All the other issues, the parties can decide between them, if they so elect.
